    Zahid Hamidi should be investigated for offences under the Election Offences Act 1954

    In speaking to members of RELA yesterday, 24th of May, 2014, in Teluk Intan, the Minister of Home Affairs, Datuk Zahid Hamidi was reported to have said that he knew of 2000 RELA members who were eligible to vote but did not vote in the last general election.[1] He was reported to have said the following: “Don’t play play with me. I know who has voted and didn’t vote.” It was also reported that Zahid Hamidi told the crowd he was able to check the ballot boxes to determine who had voted and who had note voted.[2]

    How a person voted is a secret and any violation of the secrecy of a person’s vote is an offence under Section 5 of the Election Offences Act 1954.

    I urge the office of the Attorney General to investigate Zahid Hamidi to determine if he has conducted an offence under Section 5 of the Election Offences Act 1954 (Maintenance of Secrecy of a Vote) since he claims to be able to know whether a person has voted or not. Does this also mean that he is able to determine how a person has voted? Did he request the Election Commission to supply him with his information? And is he using this ‘knowledge’ as a threat against RELA members who may not vote for the Barisan Nasional candidate?

    In addition, at the same event, it was reported that he would buy new uniforms for the RELA members in Teluk Intan if the BN candidate, Datuk Mah Siew Keong, wins the upcoming by-election on the 31st of May, 2014.[3]

    I urge the Attorney General to investigate Zahid Hamidi for bribery which is an offence under Section 10 of the Election Offences Act 1954.

    The failure of the Attorney General to act quickly and decisively in response to the remarks of Zahid Hamidi will only further increase the public perception that the office of the Attorney General only acts when it is in the interest of the BN government.
